The City of Orofino Planning and Zoning Commission, (P&Z) met for their regular meeting April 20. Commissioner Abe Blimka was not in attendance and Trapper Stewart, newly appointed commissioner was welcomed to the board.
A public hearing was scheduled with intent to amend the criteria required to utilize metal shipping containers as storage sheds within the city limits.
Orofino P&Z, as recommending board, made a recommendation to approve the following Action Item:
An amendment to the Zoning Ordinance is a request by the City of Orofino Planning and Zoning Commission proposing to amend the following:
Title 11 Chapter 2 Section 4A: Single Family Dwelling District (R-2)
A. Uses Permitted Outright: In an R-2 zone, the following uses and their accessory uses are permitted outright subject to the provisions of the adopted international codes. All other uses, structures and accessory uses not listed are strictly prohibited unless a Special Use Permit has been issued.
Title 11 Chapter 2 Section 5A: Multiple-Family Dwelling District (R-3)
A. Uses Permitted Outright: In an R-3 zone, the following uses and their accessory uses are permitted outright: subject to the provisions of the adopted international codes. All other uses, structures and accessory uses not listed are strictly prohibited unless a Special Use Permit has been issued.
Title 11 Chapter 2 Section 6A, the Mixed Use District (MXD) – Sales and Service, R-2 Residential, Title 11 Chapter 2 Section 7A, Central Business District (C-3), Title 11 Chapter 2 Section 8A, the Commercial, Industrial and Manufacturing District (C-4) and Title 11 Chapter 2 Section 9A, Special Public District, add “All other uses, structures and accessory uses not listed are strictly prohibited unless a Special Use Permit has been issued.”
Amend Section 11-2-10 General Regulations: Add Subsection E 1-3.
1. The use of prefabricated containerized transport containers, shipping containers, dry freight containers, semitrailers, or enclosed cargo vans, as accessory buildings or storage buildings shall not be permitted in the City of Orofino on property within Residential (R2 and R3) and Central Business District (C3) Zones. Mixed Use District (MXD) and Public(P) Zones shall secure a Special Use Permit to place said units. Said Units may be placed on property with the zoning designation of Industrial (C-4) as a permitted use outright.
2. Special Use Factors: The following factors will be used to consider approval of the Special Use.
a.) Location of containers in respect to setback requirements, containers shall not reduce any number of required parking spaces.
b.) Containers shall have similar color and appearance as the primary structure.
c.) Containers shall be an accessory use to the primary structure or use.
d.) Containers shall only be located on the side and rear portions of the property and positioned in such a way to be the least noticeable to other surrounding property owners.
e.) The size of the container is reasonable to the size of the lot for the intended use.
3. This prohibition does not preclude their use in conjunction with bona-fide shipping and transport activities.
Amend Section 11-2-9A: Special Public District (P) Permitted Uses: Remove, Other Public Facilities.
There were no additional questions of testimony of any kind presented at the public hearing as only the media was in attendance.
The proposed amendments will be presented to the City Council as governing board, at their meeting May 11, with recommendations for amending the Zoning Ordinance as stated above.
For those residents to have storage containers placed on their property prior to the amendments, they are excluded from the Special Use Permits as long as they are subject to the provisions of the adopted international codes.
