A RESOLUTION OF THE CITY OF ELK RIVER, CLEARWATER COUNTY, STATE OF IDAHO, TO CONSIDER THE SALE OF CERTAIN REAL PROPERTY THAT IS NO LONGER SUITABLE OR SUFFICIENT TO BE USED FOR ITS CURRENT PUBLIC PURPOSES; PROVIDING FOR VALUATION OF SAID PROPERTY; PROVIDING NOTICE AND PUBLIC HEARING FOR SAID CONSIDERATION OF SALE AND CONSIDERATION FOR SELLING SAID PROPERTY; PROVIDING THAT THE PROPERTY MAY BE SOLD UNDER CONTRACT AND FOR THE USE OF PROCEEDS FROM THE SALE.

WHEREAS the City of Elk River by and through the Mayor and City council have considered selling the property at 129 Votech Lane which has no beneficial use to the City, AND

WHEREAS said property has been appraised under terms and conditions deemed appropriate by the City council, AND

WHEREAS the City Council is considering using the money from the sale for purposes consistent with the law, AND

WHEREAS the City Council has provided notice of a public hearing held on the 12th day of June, 2019 so the public might voice their opinions regarding the afore mentioned considerations,

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF ELK RIVER AS FOLLOWS:

Section 1. That the property at 129 Votech Lane has been considered for sale by the City Council, and will be sold to the highest bidder by sealed bids for at least the value of $80,000.

Section 2. Following the public hearing, the City Council has determined that it is in the City’s best interest to sell the considered property (Idaho Cod 50-1403).

Section 3. The Council may sell for cash or contract (not exceeding 10 years) within thirty (30) days after completion of the public hearing, and issue a quitclaim deed to the buyer for said property.

Section 4. The property shall be sold at a public auction to the highest bidder and no bids shall be accepted for less than the minimum declared value of $80,000, provide however, if no bids are received, the city council shall have the authority to sell such property as it deems in the best interest of the city.

Section 5. The Council may use ALL proceeds from the sale of said property in accordance with law.
