Notice is hereby given this 29th day of March, 2021, pursuant to the Idaho Noxious Weed Law Section 22-2405 Idaho Code, to every person who owns or controls land in Clearwater County, Idaho, that noxious weeds standing, being, or growing on such land shall be destroyed or eradicated by effective cutting, tillage, cropping or treating with chemicals or other effective methods, or combination thereof, approved by the County Weed Superintendent, as often as may be required to prevent the weed from blooming and maturing seed or spreading by root, root stalks or other means.

Upon failure to observe this notice the County Weed Control Superintendent is required to proceed pursuant to the law and have weeds destroyed by such means as provided by law.

The following weeds are hereby officially designated and published as noxious, as per the authority vested in the Board of County Commissioners as per Section 22-2406, Idaho Code:

  • Musk or Nodding Thistle Dalmatian Toad Flax Giant Hogweed

Idaho Law (Idaho Code Title 22, Chapter 24) stipulates that the primary duty and responsibility for controlling noxious weeds on private land rests on the person who owns or manages the land. Any person knowing of the existence of noxious weeds on property owned or managed by him is obligated to control the weeds.

  11. Giant Knotweed
  12. Orange Hawkweed
  13. Yellow Starthistle
  14. Meadow Knapweed
  15. Giant Knotweed
  16. Japenese Knotweed
  17. Poison Hemlock
  18. Dalmation Toadflax
  19. Scotch Broom
  20. Oxeye Daisy
  21. Field Bindweed
  22. Houndtongue
  23. Bohemian Knotweed
  24. Russian Knapweed
  25. Mediterranean Sage

Idaho Code 22-2409. Violations-Penalties. Any persons knowing of the existence of any noxious weeds on land owned or controlled by him who fails to control such weeds in accordance with this chapter and any person who intrudes upon any land under quarantine or who moves or causes to be moved any article covered by this chapter except as provided or who prevents or threatens to prevent entry upon land as provided in this chapter, or who interferes with the carrying out of the provisions of this chapter or who violates any of the provisions of this chapter, shall be quality of a misdemeanor and shall be subject to a fine not to exceed one thousand dollars ($1,000.) or up to one (1) year in jail or both such find and imprisonment. Any person who violates any of the provisions of this act, or the regulations made under this act, shall be guilty of a misdemeanor.
