The City of Pierce is publishing the following ordinance pursuant to Idaho Code § 50-329. The ordinance was read and considered at the City Council meetings on May 9, July 11, and September 12, 2022, and adopted on September 12, 2022. Copies of the Franchise Agreement (Exhibit A to Ordinance No. 319) are available at City Hall, 404 S. Main Street, Pierce, Idaho.

CITY ORDINANCE NO. 319

AN ORDINANCE OF THE CITY OF PIERCE GRANTING A NON-EXCLUSIVE FRANCHISE TO AVISTA CORPORATION, DOING BUSINESS AS AVISTA UTILITIES, A WASHINGTON CORPORATION, FOR THE PROVISION OF ELECTRICITY; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST SAID FRANCHISE AGREEMENT, RESPECTIVELY; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, pursuant to Idaho Code §§ 50-301 and -329, the City of Pierce and Avista Corporation, doing business as Avista Utilities, desire to enter into a non-exclusive franchise agreement for the provision of electricity within the City of Pierce.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PIERCE, IDAHO:

SECTION 1: The “Franchise Agreement for the Provision of Electricity between the City of Pierce and Avista Corporation” (“Franchise Agreement”) is hereby approved. A copy of the Franchise Agreement is attached hereto and incorporated herein as Exhibit A.

SECTION 2: The Mayor and City Clerk are hereby authorized and directed to execute and attest the Franchise Agreement, respectively.

SECTION 3: This ordinance shall take effect and be in full force from and after its passage and publication. Additionally, the Franchise Agreement shall become effective as of the date of publication of this Ordinance No. 319 and the execution of the Franchise Agreement by all parties thereto.
